These Terms of Use ("Terms") govern your access to and use of the Move Siam website, mobile experiences, APIs, and any services we make available through them (collectively, the "Service"). The Terms apply to every visitor and to every registered account, whether you use the Service to browse listings, contact a seller, list a property of your own, or operate an agency account.
By using the Service you agree to these Terms. If you do not agree, do not use the Service.
We may publish additional rules that apply to specific features (for example, our Acceptable Use Policy, Cookie Policy, Privacy Policy, Refund Policy, and Listing Disclaimer). Those documents form part of these Terms.
You must be at least 18 years old and have the legal capacity to enter into a binding contract under Thai law to use the Service. By registering an account, you confirm that you meet both conditions.
When you create an account you agree to:
provide accurate, current, and complete information about yourself or the organisation you represent;
keep your account credentials confidential and not share them with anyone else;
notify us promptly at [email protected] if you suspect unauthorised access;
maintain only one personal account, and (for agencies) to register each agent under their own credentials.
You are responsible for everything that happens under your account.
You agree to use the Service only for lawful purposes and only in ways that comply with our Acceptable Use Policy, which is incorporated by reference. The Acceptable Use Policy describes prohibited content, anti-fraud rules, listing-accuracy obligations, and the conditions under which we may suspend or terminate accounts.
When you post a listing, send an inquiry message, publish a review, or otherwise submit content through the Service ("Your Content"), you keep ownership of that content. You grant Move Siam a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, translate, adapt, and display Your Content for the purpose of operating, promoting, and improving the Service. This licence lasts for as long as Your Content remains on the Service and for a reasonable period afterwards while we remove it from our backups.
You warrant that:
you own Your Content or have all necessary rights to grant the licence above;
Your Content is accurate, complete, and not misleading;
Your Content does not infringe any third party's rights or breach any law applicable in Thailand or any other jurisdiction where it is accessible.
We may remove, edit, or refuse to display Your Content at our discretion, particularly where we believe it breaches these Terms or the Acceptable Use Policy.
Move Siam is a technology platform. We are not an estate agent, broker, conveyancer, or party to any sale, lease, reservation, or transaction between users.
All listings are submitted by individual sellers ("private sellers") or by verified third-party agencies. We make reasonable efforts to verify lister identity (KYC for agencies) and to detect duplicate or fraudulent listings, but we do not and cannot guarantee the accuracy, completeness, or legality of any listing. Buyers must independently verify all material facts about a property — including title deed status, land area, zoning, mortgage encumbrance, and structural condition — before entering any binding contract.

Some Service features (for example seller subscriptions, agency seats, and listing-promotion boosts) require payment. Where you purchase a paid feature:
you authorise our payment processor (currently Stripe) to charge the payment method on file;
recurring subscriptions renew automatically until cancelled by you through the billing dashboard;
our Refund Policy governs the limited circumstances in which we offer refunds for our own paid services. Property transactions between buyers and sellers are out of scope for that policy.
Prices are shown in Thai Baht (THB) and include VAT where applicable. We may change prices on prospective notice; price changes do not affect the current billing cycle of an existing subscription.
The Service - including all software, design, branding, the "Move Siam" name and logo, our aggregated market data and analytics, and any documentation - is owned by Move Siam or our licensors and is protected by Thai and international intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive licence to access and use the Service for its intended purpose.
You may not copy, modify, reverse-engineer, scrape, or build a competing product from our platform or data, except as expressly permitted by these Terms or by Thai law.
The Service may link to or integrate with third-party services (for example map providers, payment processors, social networks, and analytics tools). We do not control those services and are not responsible for their content, availability, or practices. Your use of any third-party service is governed by that party's terms and privacy notice.
To the maximum extent permitted by Thai law:
the Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or free from security vulnerabilities;
listing content is provided by users — we do not warrant its accuracy, completeness, or fitness for any particular purpose;
we are not liable for the conduct of any seller, buyer, agency, or other user, nor for the outcome of any property transaction concluded off-platform.
Where we are liable to you under these Terms, our total aggregate liability in any twelve-month period is capped at the greater of (a) the fees you paid Move Siam in that period, or (b) THB 5,000. We are not liable for indirect, incidental, consequential, special, or exemplary damages, including loss of profit, loss of opportunity, or loss of data, even where we have been advised of their possibility.
Nothing in these Terms limits any liability that cannot be excluded under applicable Thai consumer-protection law.
We may suspend or close your account, remove your content, or refuse the Service to you if we reasonably believe you have breached these Terms or the Acceptable Use Policy, if your activity creates legal risk for us, or if your account has been inactive for an extended period.
You may close your account at any time from your account settings or by contacting [email protected]. We will retain personal data after closure only to the extent required by law and as described in our Privacy Policy.
We may update these Terms from time to time. Where a change is material — for example, a change that reduces your rights or increases your obligations - we will give registered users at least 14 days' notice by in-app banner and by email to the address on file before the change takes effect. Your continued use of the Service after the effective date counts as acceptance of the updated Terms.

These Terms and any dispute arising from them are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-laws rules. The courts of Bangkok have exclusive jurisdiction over any dispute that cannot be resolved by good-faith discussion between you and us.
